Re: FW: (erielack) New book w/EL content



There's an interesting quirk in Massachusetts Law (you know, the Bangor &
Portland branch of the DL&W ran up here, didn't it?  ;^)  ) which states
that once a ROW exists the tracks can ALWAYS be put back, regardless of what
happen on it.  I know of a couple developer's dreams which have been trashed
by this legal statement, since former ROW's ran across the land (in the
middle of everything, of course) and prevented development.  To officially
abandon a line takes Secretary of State approval, which is not easily
forthcoming, and this proviso gets attached every time.

A couple of those projects were mine, too . . . 8^(
