Re: (rshsdepot) RE: Seligman, AZ Harvey House demolition

Before you go spouting any more nonsense about "Eminent Domain", you should be
sure that you know what you're talking about. No government may arbitrarily exercise
that right. It can only be used when there is a clear and present need for a property, and
when the owner of said property has refused to sell for a reasonable price. That is most
emphatically NOT the case here. The property has been available for sale at a fair price,
for many years. The town has ample opportunity to raise the necessary funding. Nothing
has been done. Unless the town can now demonstrate an urgent, and over-riding need
for that building, as well as a willingness to PAY for it, they cannot claim eminent domain
at the last minute. And remember one other thing : Government CANNOT simply TAKE
a property from its owner. The owner must be compensated to the fair market value plus
any reasonable expenses involved in moving. Do you seriously think that the MAJORITY
of the citizens of that town (as opposed to a small group of enthusiasts -- who the majority
probably regard as kooks) would be willing to pay higher taxes to purchase and restore
that building ? Only in your dreams !!

Jim.
