Clause 3 of the Constitution says "The Congress shall have the power to
regulate Commerce with Foreign nations, and among the Sever States and
with the Indian Tribes."  And I am sure the Contitution of the State of
New York had a similar clause that allowed the legilature to set a guage
of 6' for the Erie Raiload.  The NY Legislature passed the law for the
Erie RR charter.

And I would say that the railroads have suffered from government
interference because of their own actions in the mid to late 19th
century and from political pressures from other groups.
