Yes, the debate over intercity/suburban trains was decided by the ICC.
Examples of such anomolies were/are:
1. The LIRR trains to Montauk (127 miles) - Commuter
2. Penn Central's "Clockers" between New York and Phila - Intercity.
3. Reading/CNJ service between Newark and Phila - Commuter.
4. The strange mix of some B&O trains between Baltimore and DC, where some
were considered intercity, others commuter.
Indeed, it was hoped that others would be considered "commuter" and the
railroads forced to operate them.
